END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement” or “EULA”) is a legally binding agreement between you (“User”, “Licensee”, “you”, or “your”) and Stratoware Private Limited (“Stratoware”, “Company”, “we”, “us”, or “our”).

This Agreement governs your access to and use of all software products, add-ons, plugins, digital content, or services developed or distributed by Stratoware, including but not limited to add-ons for Microsoft Flight Simulator, standalone simulation software, and associated digital assets (collectively referred to as the “Software Product”).

By installing, downloading, accessing, or using the Software Product, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not install, access, or use the Software Product.



1. License Grant

Subject to compliance with this Agreement, Stratoware grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software Product solely for personal, non-commercial use.

The license permits:

• Installation and use on up to three (3) devices, provided the purchaser remains the primary user of the Software Product.
• Use of the Software Product only by the original purchaser unless explicitly authorized by Stratoware.

This license does not transfer ownership of the Software Product. All intellectual property rights remain the exclusive property of Stratoware or its licensors.

 



2. Ownership and Intellectual Property

The Software Product is licensed, not sold.

All rights, titles, and interests in the Software Product, including but not limited to:

• software code
• aircraft models
• textures
• visual assets
• documentation
• audio
• animations
• configuration files

are owned by Stratoware Private Limited or its respective licensors and are protected under applicable copyright, trademark, and intellectual property laws.

Nothing in this Agreement grants you any ownership rights in the Software Product.

 



3. Device Limitations

A valid license permits installation on a maximum of three (3) devices, provided:

• the purchaser remains the primary user
• the Software Product is not simultaneously used in violation of this Agreement
• the Software Product is not redistributed or shared

Stratoware reserves the right to implement license verification systems to enforce these limits.

 



4. Restrictions

You agree that you will not, directly or indirectly:

• redistribute, sell, sublicense, or share the Software Product
• extract assets from the Software Product for use outside the intended environment
• reverse engineer, decompile, or disassemble the Software Product
• create derivative commercial works from the Software Product
• bypass, disable, or interfere with license protection mechanisms
• distribute the Software Product through file-sharing services or unauthorized platforms
• use the Software Product in violation of applicable laws

Any unauthorized distribution or reproduction of the Software Product constitutes a material breach of this Agreement.

 



5. Modding Policy

Stratoware permits limited community modifications where explicitly supported by the Software Product.

Permitted examples include:

• creation of liveries or skins for aircraft add-ons
• configuration adjustments where allowed by the product

However, users may not:

• extract models, textures, or proprietary assets
• redistribute internal assets of the Software Product
• create competing commercial products based on Stratoware assets

Stratoware reserves the right to determine whether a modification violates these restrictions.

 



6. License Transfer

The Software Product license may not be transferred, resold, assigned, or sublicensed without prior written permission from Stratoware.

Unauthorized transfers will result in automatic termination of the license.

 



7. Backup Copies

Users are not permitted to create backup copies of the Software Product unless explicitly authorized by Stratoware in writing.

 



8. Commercial Use

The Software Product is licensed strictly for personal, non-commercial use unless otherwise stated.

Commercial use includes, but is not limited to:

• flight training environments
• paid simulation experiences
• commercial simulators
• professional training organizations
• corporate demonstrations
• commercial content production involving the software

Commercial use requires a separate commercial license agreement with Stratoware.

Commercial licenses are typically granted per seat or per simulator station and are subject to separate contractual terms.

 



9. Updates and Modifications

Stratoware may:

• release updates
• modify software functionality
• discontinue products
• require updates for continued compatibility

Stratoware is not obligated to provide updates unless explicitly stated.

 



10. Online Services and Account Access

Some Software Products may require:

• account authentication
• activation
• online services

Stratoware reserves the right to implement account verification mechanisms when necessary.

Certain products may function fully offline, while others may require periodic authentication.

 



11. License Revocation

Stratoware reserves the right to suspend or terminate licenses at its sole discretion if:

• this Agreement is violated
• unauthorized redistribution occurs
• fraudulent activity is detected
• intellectual property rights are infringed

Upon termination, the user must immediately cease use of the Software Product and delete all installed copies.

 



12. User Generated Content

Users may create and publish media content based on the Software Product, including:

• screenshots
• videos
• livestreams
• reviews

Ownership of such media remains with the creator.

However, users may not distribute extracted assets or proprietary content from the Software Product.

 



13. Third-Party Content

The Software Product may contain third-party assets, libraries, trademarks, or technologies licensed to Stratoware.

Such content remains the property of their respective owners and may be subject to separate licensing terms.

Use of trademarks does not imply endorsement by third-party organizations.

 



14. Simulation Disclaimer

Unless explicitly stated otherwise on a product page:

The Software Product is not certified for real-world aviation training and must not be relied upon for operational or safety-critical aviation purposes.

The Software Product is intended solely for entertainment and general simulation purposes.

 



15. Disclaimer of Warranties

The Software Product is provided “as is” and “as available.”

Stratoware makes no guarantees or warranties, express or implied, including but not limited to:

• uninterrupted operation
• compatibility with all systems
• error-free performance
• suitability for specific purposes

 



16. Limitation of Liability

To the maximum extent permitted by applicable law, Stratoware shall not be liable for:

• loss of data
• loss of profits
• system damage
• business interruption
• indirect or consequential damages

arising from the use or inability to use the Software Product.

 



17. Governing Law

This Agreement shall be governed by the laws of Mumbai, Maharashtra, India.

 



18. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through the following process:

  1. Good-faith negotiations between the parties.
  2. Arbitration conducted in Mumbai, India.
  3. If arbitration fails, disputes shall be resolved in the competent courts of Mumbai, Maharashtra.

 



19. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 



TERMS OF SERVICE

 

1. Overview

This website and associated services are operated by Stratoware Private Limited.

By accessing our website, purchasing products, or using our services, you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use our services.

 



2. Digital Products

Stratoware offers digital software products and add-ons which may be delivered via:

• direct download
• third-party platforms
• digital marketplaces

Availability may vary depending on distribution platforms.

 



3. Product Availability

We reserve the right to:

• limit product availability
• discontinue products
• modify pricing
• restrict access in certain jurisdictions

without prior notice.

 



4. Refund Policy

All software products sold by Stratoware are non-refundable.

Digital software products delivered electronically are considered final sales and cannot be returned or exchanged.

Stratoware will make reasonable efforts to resolve technical issues.

If a problem cannot be resolved, Stratoware may, at its sole discretion:

• provide a replacement product
• issue store credit

Requests are evaluated case-by-case.

 



5. Accuracy of Information

While we attempt to provide accurate information, we do not guarantee that all product descriptions, images, or specifications are free from errors.

Stratoware reserves the right to correct errors at any time.

 



6. Prohibited Activities

Users may not use the website or services to:

• violate applicable laws
• distribute malicious software
• attempt unauthorized access
• scrape or harvest data
• interfere with service functionality

Violation may result in termination of access.

 



7. Third-Party Platforms

Stratoware products may be distributed through third-party marketplaces or platforms.

Purchases through such platforms are subject to both these Terms and the terms of the respective platform.

 



8. Changes to Terms

Stratoware reserves the right to modify these Terms at any time.

Continued use of the website or services after updates constitutes acceptance of the revised Terms.
